1) About Eternel & Contract Formation

2) Eligibility & Accounts

• Age: The Services are intended for users aged 13+ (or higher where required by local law). If you are under the applicable age, you may only use the Services with verifiable parental/guardian consent when legally required.
• Accounts: Some features may require you to create an account or authenticate with third-party platforms. You must provide accurate information and keep your credentials secure. You are responsible for activities under your account.

3) Community Conduct

To maintain a safe, creative environment, you agree not to:

• Harass, threaten, impersonate, dox, or engage in hateful, illegal, or otherwise harmful conduct.
• Attempt to gain unauthorized access, interfere with servers, or deploy malware/cheats/exploits.
• Upload or distribute content that is unlawful, infringing, or violates the rights of others.
• Bypass moderation, ban evasion, or engage in behavior that undermines fair play in events/games.

We may moderate, restrict, or terminate access for violations. See Section 10 (Termination).

4) User-Generated Content (UGC) & License

You retain ownership of UGC you create or submit (e.g., builds, scripts, visuals, text). By submitting UGC to or within the Services, you grant Eternel a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, modify, create derivative works from (for technical and game integration purposes), publicly display, and distribute your UGC in connection with operation, promotion, and improvement of the Services and events.

You represent and warrant you have the necessary rights to grant this license and that your UGC does not infringe third-party rights. Where a platform’s own terms apply (e.g., Roblox, Fortnite Creative), you agree to comply with those platform terms in addition to these Terms.

5) Intellectual Property of Eternel

All Eternel trademarks, logos, names, artwork, code, documentation, and other materials are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from Eternel IP without our prior written permission.

6) Events, Challenges & Rules

Participation in specific events (e.g., Surviland RP, SquidGame) may be subject to additional rules posted at registration or within the event hub. By joining, you agree to follow those rules. Organizers may make reasonable adjustments for fairness, security, or technical reasons.

Any prizes or rewards (if applicable) will be governed by the event rules and may be void where prohibited by law. Taxes or reporting obligations (if any) are the responsibility of the participant.

7) Third-Party Services & Links

We may integrate or link to third-party services (e.g., hosting, analytics, social media, game platforms). Those services are governed by their own terms and privacy policies. Eternel is not responsible for third-party content or practices.

8) Privacy & Cookies

Your use of the Services is also governed by our Privacy Notice. We use strictly necessary cookies and may request consent for optional cookies/analytics. You can adjust choices through our cookie banner (where available).

9) Disclaimers

• As-is: The Services are provided “as is” and “as available”. We do not guarantee uninterrupted access, freedom from errors, or compatibility with all devices.
• Beta/experimental: Some features or events may be experimental. You use them at your own risk.
• No professional advice: Nothing in the Services constitutes legal, financial, or other professional advice.

10) Suspension & Termination

We may suspend or terminate access to the Services (or specific features) at any time, with or without notice, if we reasonably believe you violated these Terms, platform rules, or applicable law, or where continued service is not feasible (e.g., technical/legal reasons). You may stop using the Services at any time.

11) Liability

To the maximum extent permitted by law, Eternel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for fraud or willful misconduct).

12) Indemnity

You agree to defend, indemnify, and hold harmless Eternel and its team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your UGC, your breach of these Terms, or your violation of law or third-party rights.

13) Changes to the Services & Terms

We may modify the Services or these Terms to reflect improvements, new features, legal requirements, or business changes. We will post updates on this page and adjust the effective date. Material changes may also be communicated by reasonable means. Continued use after changes constitutes acceptance.

16) Notices & Miscellaneous

• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: We may assign these Terms; you may not assign them without our written consent.
• Entire agreement: These Terms (plus specific event rules and the Privacy Notice) are the entire agreement between you and Eternel regarding the Services.
